QUANTITY: The contractual quantity for sale to the Buyer Under the terms of this Agreement shall be a purchase of gold Nuggets or Bars **4Kg



 



PRICE:



 



The total price payable by the Buyer is fixed at US$*9,**0/KG



 



DELIVERY TERMS:



 

1. The delivery terms for this FCO shall be on CIF buyer refinery.

 



b)            Buyer will have independent analysis from the samples to be collected from the consignment, and it shall be the proof of quality and quantity/weight.



 



c)            All the expenses of Customs rates of export and import, transport, insurances, etc, are included in the price indicated in the corresponding section, except is the ownership certificate that will be issued on buyers name from Kenya Authority to enable shipment. The Buyer and the seller will undertake to facilitate the shipment of the Gold to the destination refinery.



 



 

1. The merchandise will be given to the Buyer once the full payment is obtained.

 



f) Payment will be done in favor of the seller against Assay report from the buyer nominated refinery.



 



Seller will appoint one official from his side to accompany the gold with the buyer to buyers destination to get the payment after final assay.



 



PAYMENT TERMS:



 



1.)The payment will be by means of bank-Bank transfer and shall be payable within of ****2 hours after final assay at buyers destination.



 



DOCUMENTS:



 



Each delivery shall be identified with all appropriate contract reference codes and numbers. Seller must provide the following documents to Buyer:



 



a.) Three originals of Commercial Invoices in favor of the Buyer.



 



b.) Certificate of Origin.



 



c.) Certificate of Ownership on buyers name.



 



d) Airway bill



 



e.) Gross weight and net weight.



 



f.) All necessary document for the export-import of gold.



 



 



 



First (1st) Step:



 



Interchange of FCO + DRAFT CONTRACT, and any documentation to support the transaction from Buyer/Seller.



 



Second (2nd) Step:



 



The buyer or his representative will travel to Kenya for the first assay test and arrangements of the good to be shipped to his destination.



 



Third (3rd) Step:



 



The two parties accept the accomplishment of the services stipulated in the sales purchase agreement, total protection of the merchandise until the final delivery to the Buyer once the payment terms agreed above have been met.



 



 



 



 



 



CHARACTERISTICS OF THE GOLD NUGGETS OR BARS



 



Deleterious elements in refining material:



 



In the following, the most common impurities in refining result are accepted and limits are formulated below to which are gold nuggets or Bars is acceptable without additional amounts being charged to the Seller.



 



These limits are to be considered as indications by the refinery and have to be re-evaluated depending on the gold nuggets and the process of refining it is destined for.
